Acceptance of These Terms

Welcome to Boutique Jolie ("Boutique Jolie"), a trade name and doing business as ("d/b/a") of Blush Boutique Inc. Throughout these Terms of Service, "Boutique Jolie," "Blush Boutique Inc.," "Company," "we," "our," and "us" refer collectively to Blush Boutique Inc., a Michigan corporation, doing business as Boutique Jolie.

Boutique Jolie grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Website solely for your personal, lawful, and non-commercial shopping purposes. No ownership rights are transferred through your use of the Website.

However, product images are provided for illustrative purposes only, and actual colors, textures, patterns, and appearances may vary depending upon your device, monitor settings, lighting conditions, manufacturing variations, or other factors beyond our control.

Product sizing information is provided as a general guide. Because sizing may vary by manufacturer, fabric, or style, Boutique Jolie cannot guarantee that every garment will fit identically. Customers are responsible for reviewing sizing information before placing an order.

All products are offered subject to availability. Boutique Jolie reserves the right to discontinue products, modify product offerings, substitute comparable products when appropriate, limit quantities, or update product descriptions at any time without prior notice.

We reserve the right to correct typographical errors, pricing inaccuracies, inventory discrepancies, or other errors appearing on the Website, even after an order has been submitted.

Orders, Pricing, and Payment

All orders placed through the Website are subject to acceptance by Boutique Jolie. Your submission of an order does not constitute our acceptance of that order or create an obligation for us to sell any product. We reserve the right, in our sole discretion, to refuse, limit, or cancel any order for any lawful reason, including but not limited to product availability, pricing errors, suspected fraud, inaccuracies in billing or shipping information, violations of these Terms, or suspected unauthorized resale activity.

All prices displayed on the Website are stated in U.S. Dollars unless otherwise indicated and are subject to change without prior notice. While Boutique Jolie makes reasonable efforts to ensure pricing accuracy, typographical errors, technical issues, or system malfunctions may occasionally result in incorrect pricing or product information. We reserve the right to correct any such errors and to cancel or refuse orders placed using inaccurate pricing, even after payment has been authorized. If your order is canceled after payment has been processed, your sole remedy will be a refund of the amount charged.

By submitting an order, you represent and warrant that you are authorized to use the payment method provided and authorize Boutique Jolie and its payment processors to charge the applicable purchase price, taxes, shipping charges, and any other disclosed fees. If a payment cannot be successfully processed, we may suspend or cancel your order until payment is successfully completed.

Boutique Jolie utilizes independent third-party payment processors to facilitate online transactions. We do not store complete payment card information on our servers, and all payment processing is subject to the terms, conditions, and privacy practices of the applicable payment processor.

Fraud Prevention

To protect our customers and our business, Boutique Jolie reserves the right to verify customer identity, payment information, billing addresses, shipping addresses, and order details before fulfilling any order. We may request additional documentation or information to confirm the legitimacy of a transaction.

Orders that appear fraudulent, involve unauthorized payment methods, contain conflicting account information, or otherwise present an elevated risk of fraud may be delayed, canceled, or refused without liability. Boutique Jolie further reserves the right to cooperate with financial institutions, payment processors, law enforcement agencies, and governmental authorities in the investigation of suspected fraudulent activity.

Shipping and Delivery

Boutique Jolie will make commercially reasonable efforts to process and ship orders within the estimated timeframes displayed on the Website. Shipping estimates are provided for convenience only and are not guaranteed. Delivery dates may vary due to inventory availability, weather conditions, shipping carrier delays, holidays, customs processing, or other circumstances beyond our reasonable control.

Risk of loss and title for purchased products pass to the customer upon delivery of the products to the shipping carrier unless otherwise required by applicable law. Boutique Jolie shall not be liable for delays, lost shipments, damaged packages, or delivery failures caused by shipping carriers or events outside our reasonable control.

Customers are responsible for providing complete and accurate shipping information. Boutique Jolie is not responsible for shipments delayed, returned, or misdelivered due to inaccurate or incomplete addresses provided by the customer. Additional shipping charges resulting from returned packages or reshipments may be the responsibility of the customer.

Returns, Exchanges, and Refunds

Boutique Jolie strives to provide quality merchandise and customer satisfaction. Returns, exchanges, store credits, and refunds are governed by the Boutique Jolie Return Policy, which is incorporated into these Terms by reference and may be updated from time to time.

To the extent permitted by applicable law, Boutique Jolie reserves the right to deny returns or exchanges that do not satisfy the requirements of the applicable Return Policy, including products that have been worn, washed, altered, damaged, or returned outside the permitted return period.

Refunds, where approved, will generally be issued using the original method of payment unless otherwise required by law or agreed by Boutique Jolie. Shipping charges, expedited shipping fees, and other service-related charges are generally non-refundable unless required by applicable law.

Promotions, Discounts, and Store Credits

Boutique Jolie may periodically offer promotional discounts, coupon codes, loyalty rewards, gift cards, referral incentives, or other promotional programs. Unless expressly stated otherwise, promotional offers may not be combined with other discounts and have no cash value.

Boutique Jolie reserves the right to modify, suspend, or discontinue any promotional program at any time without prior notice. Gift cards, promotional credits, and store credits are subject to any additional terms accompanying their issuance and, except where required by law, are not redeemable for cash.

SMS, Email Communications, and Electronic Notices

By creating an account, placing an order, subscribing to newsletters, or otherwise providing your contact information, you consent to receive electronic communications from Boutique Jolie relating to your account, purchases, customer service inquiries, transactional updates, and other information regarding your relationship with us.

If you separately opt in to receive marketing emails or SMS messages, you consent to receive recurring promotional communications in accordance with your consent preferences. Message frequency may vary, and message and data rates may apply to SMS communications. Consent to receive marketing messages is voluntary and is not a condition of making a purchase.

You may unsubscribe from marketing emails by using the unsubscribe link included in our communications. You may opt out of SMS marketing at any time by replying STOP to any marketing text message. Your participation in our SMS messaging program is also governed by our Mobile Messaging Terms and our Privacy Policy.

User Content and Customer Reviews

Boutique Jolie reserves the right, but assumes no obligation, to monitor, edit, refuse, or remove User Content that we determine, in our sole discretion, is unlawful, offensive, misleading, defamatory, infringes intellectual property rights, violates these Terms, or is otherwise inappropriate.

Intellectual Property Rights

The Website and all content made available through it, including without limitation all trademarks, trade names, logos, service marks, product names, graphics, photographs, videos, artwork, page layouts, text, software, source code, designs, product descriptions, compilations, databases, and other materials, are owned by Boutique Jolie or its licensors and are protected by United States and international intellectual property laws.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOUTIQUE JOLIE, ITS PARENT COMPANIES, AFFILIATES, OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, VENDORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE WEBSITE, YOUR PURCHASE OF PRODUCTS, OR THESE TERMS, INCLUDING LOST PROFITS, LOST DATA, LOSS OF BUSINESS OPPORTUNITIES, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOUTIQUE JOLIE'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE WEBSITE, PRODUCTS, OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO BOUTIQUE JOLIE FOR THE PRODUCT GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT, OR (B) ONE HUNDRED U.S. DOLLARS (US $100.00).

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY; THEREFORE, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Indemnification

You agree to indemnify, defend, and hold harmless Boutique Jolie, its affiliates, officers, directors, employees, agents, successors, assigns, vendors, and service providers from and against any claims, liabilities, damages, judgments, settlements, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to your violation of these Terms, misuse of the Website, violation of applicable law, infringement of any third-party rights, or negligent or wrongful conduct.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles.

Any dispute arising from or relating to these Terms, the Website, or any purchase made through Boutique Jolie shall be resolved exclusively in the state or federal courts located in Kent County, Michigan. You irrevocably consent to the personal jurisdiction and venue of those courts.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY CLAIM SHALL BE BROUGHT SOLELY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, COLLECTIVE, OR REPRESENTATIVE ACTION.

Changes to These Terms

Boutique Jolie reserves the right to modify these Terms at any time. Updated Terms become effective immediately upon posting to the Website unless a later effective date is expressly stated. Your continued use of the Website after revised Terms have been posted constitutes your acceptance of the revised Terms.
